Signature FSE Limited (hereinafter referred to as the company) reserves the right to alter or amend the following conditions, without redress, except where contracts will be concluded under the conditions ruling at commencement of contract.

2. Contract

A contract is deemed to be an official written order placed with the company via our web site www.chefstablebysignature.co.uk or email for the supply of goods and/or services at the agreed price prior to delivery of any goods or services. The company is willing to enter into any formal contract subject to having sight of all conditions of that contract prior to agreeing to supply goods or services at the agreed written price.

3. Validity of Quotation

A quotation is offered for acceptance within 30 days of the date of the issue of the quotation. No order received from a customer by the Company and no purported variation of these terms shall constitute a contract until accepted in writing by the Company.

4. Prices

All prices quoted are in GBP Sterling (unless otherwise stated) and exclude VAT at the rate applicable for which the customer shall be additionally liable at the time of invoicing or payment. Prices quoted by the Company are those prevailing at the time, but we reserve the right to adjust if necessary due to currency fluctuations, raw material or factory increases.

5. Terms of Payment

If you are a business customer who does not hold a credit account with us, payment must be made to us at the time of placing your order.  This does not affect your rights of cancellation of your order as set out in these Terms.

Unless otherwise agreed, approved credit accounts are strictly net and payable within 30 days of submission of invoice for goods or services. The company will continue to maintain credit accounts subject to payments being made within the agreed period of time. The company retains the right to withdraw credit accounts when payments are not in accordance with the above. The company also retains the right to discontinue supply of goods or services until outstanding invoices have been paid in full. If payment is not made on or before the due date, the Company will charge interest at the rate of 2.5% per annum from the due date for payment until the date of actual payment and shall further be entitled to statutory compensation pursuant to the Late Payment of Commercial Debts Regulations 2002.

The Company’s obligation in the event of a breach of this warranty is limited to the repair or replacement of any defective goods, which shall be returned to the Company by the customer. This warranty is given in lieu of all other warranties or conditions expressed or implied (whether by statue or otherwise) and is subject to the following conditions:

9.5 All returns are discretionary and requests to return goods must be made in writing or by completing the ‘returns request’ form. In any instance, goods need to be reported and returned to Signature FSE Ltd within 15 days from the invoice date. A restocking charge of 30% of the goods or £30 whichever is the greater will apply to any authorised returns. Delivery costs are non-refundable, unless the product is faulty.

9.6 Goods returned must be in their original packaging, in the correct carton quantity, unused and in perfect condition with any labels and tags still intact and without additional labels or writing on the packaging. Items must be appropriately packaged for delivery. The Customer is responsible for the costs of returning the goods.

Only once the items have been received, inspected and approved will a credit be issued. All returns are at the sole discretion of Signature FSE Ltd and we reserve the right to amend our policy at any time and without notice.

We will allow you to cancel your order for goods or any time prior to despatch by contacting us.  Where payment has already been taken in respect of the order, we will process a refund in respect of the goods cancelled within 7 business days.

The risk in the goods shall pass to the customer on delivery to the customer or (if earlier) when possession of the goods is taken by the carrier for delivery to the customer.

11. Force majeure

The Company shall not be liable to the customer, or deemed to be in breach of any contract with the customer, by reason of any delay in performing, or any failure to perform, any of the Company’s obligations in relation to the goods if the delay or failure was due to force majeure or to any other cause beyond the Company’s reasonable control.

12. Patent rights

The acceptance of a quotation includes the recognition by the customer of the right of the Company under any patent rights, trademarks, registered designs or other intellectual property rights relating to the goods, and the customer undertakes that patent numbers, trademarks or other trade markings on goods supplied shall not be obliterated, altered or defaced.
